STF decides to extinguish José Dirceu's sentence for corruption in Lava Jato; Understand the details of the case

The Federal Supreme Court (STF) decided this Tuesday (21), by majority, to extinguish José Dirceu's sentence under Operation Lava Jato, one of the largest corruption investigations in Brazilian history. Dirceu was sentenced for passive corruption and money laundering by the 13th Federal Court of Curitiba. The total sentence for both crimes was set at 8 years, 10 months and 28 days. In the 2nd Panel, the result was 3 votes in favor and 2 against, declaring that the sentence was time-barred, indicating that the deadline to punish Dirceu in this case had expired.
In the vote on the penalty, ministers Ricardo Lewandowski, Nunes Marques and Gilmar Mendes opted for its extinction, while Edson Fachin (rapporteur) and Cármen Lúcia defended its maintenance. Although Ricardo Lewandowski has already retired from the STF and currently holds the position of Minister of Justice in the Lula government, his vote in the case remained valid. Since 2022, the process has been analyzed by the 2nd Panel.
Operation Lava Jato
Operation Lava Jato, a series of investigations carried out by the Federal Police of Brazil, triggered an intense search for justice, although it was the subject of controversy. With more than a thousand warrants executed, including search and seizure, temporary and preventive arrests, as well as coercive conduct, His goal was to uncover a vast money laundering scheme, known as Petrolão, which generated billions of reais in bribes.
Started on March 17, 2014, under the coordination of then judge Sérgio Moro, the operation involved 80 authorized phases, resulting in the arrest and conviction of more than one hundred individuals, until its conclusion on February 1, 2021. Widely seen as a contributing factor to the 2014 political and economic crisis in Brazil, it revealed the involvement of members of Petrobras' senior management, politicians from the main Brazilian parties and businesspeople from large corporations in the country in corrupt practices.
The José Dirceu Case in Lava Jato
José Dirceu, former minister of the Civil House during the first term of Luiz Inácio Lula da Silva's government, was convicted of corruption and money laundering within the scope of Lava Jato. The charges against him involved the receipt of bribes arising from overpriced contracts between contractors and Petrobras, Brazilian state-owned company.According to the allegations of the Lava Jato operation, there is an accusation that Dirceu received a bribe equivalent to 30% of the value of a contract established between Petrobras and the company Apolo Tubulars, a supplier of tubes to the state-owned company, during the period from 2009 to 2012.
The sentence that convicted Dirceu was handed down by federal judge Sérgio Moro, in the first instance, and confirmed by the Federal Regional Court of the 4th Region (TRF-4), in the second instance. Based on these decisions, Dirceuwas sentenced to 4 years and 7 months in prison for corruption.
Extinction of the Penalty
The former federal deputy's lawyers based their defense mainly on the statute of limitations. They argued that, when the conviction was published in March 2017, the alleged 2009 crime was already prescribed. Due to Dirceu's age, which was over 70 years old at the time of his conviction, the statute of limitations was reduced by half, as provided for in Brazilian legislation. The process, which began in 2021 and concluded today, did not address the central issue of Dirceu's guilt in the alleged crime. Instead, the focus was on the statute of limitations, debating the time that had passed since the alleged offense.
