Judge rejects case in which Trump is accused of misappropriation of classified documents

A Florida judge dismissed a lawsuit accusing former President Donald Trump of misappropriating classified documents in his mansion. According to Judge Aileen Cannon, who was in charge of the case, Special Prosecutor Jack Smith did not have the authority to take the case to court. It is worth noting that Cannon was appointed by Trump in 2020, during his presidential term. The prosecution can still appeal the decision. This victory is significant for the former president, especially just days after an assassination attempt on him by a sniper.
The Case
The lawsuit, initiated in August 2023, alleged that Trump had taken documents classified as classified with him when he left the White House in January 2021. These documents, according to the indictment, contained sensitive information that could compromise national security. The lawsuit was filed by the United States Department of Justice, which said it had evidence that Trump knowingly kept these documents at his Mar-a-Lago, Florida residence.
The former president is facing 40 criminal charges related to the alleged mishandling of confidential documents. Trump has pleaded not guilty to several charges, including intentionally withholding national defense information and obstructing the federal government's attempts to recover those documents. Trump is also accused of showing information to people without security clearances, randomly holding them at his Mar-a-Lago residence, and making false statements.

The judge, in a 93-page decision, granted Trump's request to dismiss the federal case, arguing that the Department of Justice's appointment of Attorney Smith violates the Appointments Clause of the U.S. Constitution. According to Cannon, the court considers that the prosecution of Special Counsel Smith in this action compromises two structural foundations of the constitutional scheme: the role of Congress in appointing constitutional agents and in authorizing expenditures by law.
Smith was appointed by Attorney General Merrick Garland rather than being nominated by the president and confirmed by Congress. Furthermore, his office was irregularly funded by the Department of Justice. The initial idea was seen as unlikely and even absurd, but it gained credibility after Supreme Court Justice Clarence Thomas endorsed the theory. During last month's hearings, the prosecutor's team vigorously challenged that argument.
The Trump-appointed Florida judge has indefinitely postponed the ruling on the confidential federal documents, saying there are significant questions about the evidence in the case. Prosecutor Smith now has the option of appealing Monday's ruling to a lower court and request the appointment of a new judge for the case. To date, Smith has not commented publicly on Judge Cannon's decision.
The strategy of Trump's lawyers in all court cases where he is a defendant consists of trying to postpone the cases, betting on the possibility that he will win this year's election. In the presidency, it is believed that it will be more difficult to prosecute him. Judge Cannon stated in her ruling that this determination applies specifically to this case and does not cover a second case overseen by Mr. Smith that deals with alleged efforts to overturn the 2020 election.
